What kind of reactions will I find on My Vessels?

The Norwegian Maritime Authority issues four types of reactions:

  • orders to rectify
  • comments
  • non-conformities
  • observations

Orders to rectify and comments are issued in connection with administrative procedures and inspections.
Non-conformities and observations are issued in connection with the revision of safety management systems.

Orders to rectify

An order to rectify is an individual decision that binds the shipowner's duties within a given time frame.

An order to rectify is linked to a clear defect in relation to regulations related to the current certificate or permits.

If an order to rectify is not complied with, the Norwegian Maritime Authority can impose sanctions, for example invalidation of certificates and daily fines.

An order to rectify is an individual decision in compliance with the Public Administration Act and can be appealed.

Comments

A comment is first and foremost a guideline.

Typically, possible errors or deficiencies are pointed out in relation to the regulations, or additional documentation or confirmations may be required.

A comment is often used for ships under construction/reconstruction or longterm repair.

A comment is not an individual decision in compliance with the Public Administration Act and cannot be appealed. However, if the comment is converted to a deficiency it may be appealed.

Non-conformites

The Norwegian Maritime Authority can issue two types of nonconformities:

Non-conformity

A non-conformity is an observed situation where there is objective evidence that a particular requirement is not met.

A non-conformity is an individual decision in compliance with the Public Administration Act and can be appealed.

Major non-conformity

A major non-conformity is an identified non-conformity that poses a serious threat to the safety of human life, ships and the environment.

A major non-conformity is a non-conformity that reflects serious failure in compliance with the security management system and requires immediate corrective action. It can also be a non-conformity if a requirement of the ISM Code is not implemented effectively and systematically.

A major non-conformity is an individual decision in compliance with the Public Administration Act and can be appealed.

Observations

An observation is a statement that something in the system does not meet the formal requirements in an adequate way and this is supported by objective evidence.

There may also be conditions that can lead to non-conformites if measures are not taken.

An observation is not an individual decision in compliance with the Public Administration Act and cannot be appealed.

Where can I find reactions issued for my vessel?

On the front page of My Vessels you can select the vessel you want to view.

When you select a vessel you will find the tab "REACTIONS".

Next to REACTIONS you will see a number if there are any open reactions.

Press the tab to view all open reactions for this vessel.

The default view shows all open reactions.

You can also look at the different reaction types by pressing their respective buttons; Non-conformites, Deficiencies, Comments, Observations.

You will see an overview of closed reactions by pressing the "Closed" button.

How can I ask questions about a reaction?

You can submit questions related to a reaction by clicking "History and Dialogue" to the right of the reaction.

A dialog will then open, showing the reaction history and former dialogue.

In the "Comment" field you can ask questions related to the reaction.

Your submitted comment will then be a part of the dialogue.

The Norwegian Maritime Authority will receive your message and see who sent it.

A reply to your message will be given in this dialog.

An e-mail will also be sent to you stating that the Norwegian Maritime Authority has answered your question.

Note! The box for e-mail notification must be activated for each vesselon My Vessels.

Finding history and dialogue for a closed reaction

When a reaction is closed you will find history and dialogue related to the reaction by clicking "Closed" (see above).

Here you will find all history and dialogue related to the reaction.

The reason for a reaction to be closed will also be stated here.

How do I respond to a reaction?

By ordering a new control/check on board your vessel.

The Norwegian Maritime Authority can issue reactions where the requirement for closure is "New control on board".

For these types of reactions, an inspector from the Norwegian Maritime Authority is required to board the vessel to ensure that the necessary improvements have been made.

Note! It is the case manager / inspector at the Norwegian Maritime Authority who closes this type of reaction.

How do I order a new control on board?

On My Vessels you will find the button "Order new check on board" for the reaction.

When you press the button you will see this dialog.

Here you will be able to submit a request for a new control on board.

It is also possible to attach documentation for the inspector to see during the inspection.

By uploading required documentation

The Norwegian Maritime Authority can issue reactions where the requirement for closure is "Confirmation by documentation".

This type of reaction requires that the owner can document that the necessary improvements have been made.

Note! It is the case manager / inspector at the Norwegian Maritime Authority who closes this type of reaction.

How do I upload documentation?

You can upload documents related to the issued reaction on My Vessels.

This is done by pressing the "Upload Documents" button

The following dialogue appears. In addition to adding files, you can also post messages.

You will see the following screen while uploading.

When the process is finished you will see a confirmation.

You will also be able to see which files that are uploaded.

By closing the reaction yourself

The Norwegian Maritime Authority can issue reactions where the requirement for closure is "Confirmation from the shipping company / Captain".

For this type of reaction, the shipping company or Captain can close the reactions.

How do I close a reaction myself?

To close this type of reactions, press the button "Confirmation of own control".

The following window will be shown.

Press "Confirm" to close the reaction.

In History and dialogue, under closed reactions, you will find a confirmation that the reaction has been closed by the shipowner/captain.
